Appointment Booking, Payment, Rescheduling and Cancellation Policy
By proceeding with the booking and provision of a remote consultation, the Patient declares that they have read, understood and fully accept the terms of this Informed Consent.
Clause 1
(Scope and nature of the clinical act)
-
This Informed Consent applies to the provision of remote clinical acts, carried out via video call, according to the nature of the service purchased, such acts being provided by Graceful Existence - Unipessoal Lda., with Tax Identification Number 515943371, holder of ERS Registration E151017.
-
A remote clinical act constitutes a professional healthcare act, performed by a legally qualified professional registered with the respective Professional Association, and is governed by the applicable legal provisions, codes of professional ethics and good clinical practices in force in Portugal.
-
The Patient acknowledges that this consent applies both to one-off clinical acts and to recurring clinical acts, where this results from the nature of the contracted clinical follow-up.
Clause 2
(Purpose of the remote consultation)
-
The remote consultation is intended for the clinical assessment of the Patient, the collection of relevant information, the clarification of questions, therapeutic guidance, clinical follow-up and, where clinically indicated, the issuance of reports, statements or other clinical documents legally permitted to be issued by the Healthcare Professional.
-
The Patient understands that the remote consultation does not necessarily replace an in-person consultation, and that Graceful Existence - Unipessoal Lda., through its Healthcare Professional, or any other member, may at any time determine that an in-person examination, additional assessments or referral to other healthcare services is clinically necessary.
Clause 3
(Limitations and risks of remote provision)
-
The Patient declares that they have been informed of and understand that the provision of remote healthcare has inherent limitations, namely:
a) Inability to perform a complete physical examination;
b) dependence on the quality of audio and/or video communication;
c) risk of technical failures, connection interruptions or technological limitations;
d) possible need for additional information or an in-person assessment to confirm a diagnosis.
-
If Graceful Existence - Unipessoal Lda., through its Healthcare Professional, considers that these limitations compromise the safety, quality or appropriateness of the clinical assessment, it may interrupt, reschedule or refuse to continue the remote clinical act, proposing an appropriate clinical alternative.
Clause 4
(Identification and duties of the Patient)
-
The Patient undertakes to:
a. Provide truthful, complete and up-to-date clinical information, including personal medical history, medication currently being taken, allergies, symptoms and relevant examinations;
b. Correctly confirm their identity whenever requested;
c. Confirm the identity of any accompanying person, where applicable;
d. Ensure that they are in a private, quiet and suitable environment, safeguarding the confidentiality of the clinical act;
e. Have the minimum technical means necessary to carry out the consultation.
-
The Patient acknowledges that omitting or providing incorrect information may compromise the clinical assessment and exempts the Healthcare Professional from liability for the consequences arising therefrom.
Clause 5
(Clinical decision and prescription)
-
The Patient expressly acknowledges that:
a. Payment for the clinical act corresponds to the professional assessment, clinical time and technical knowledge of the professional assigned to the clinical act;
b. The prescription of medication and the issuance of prescriptions, reports, certificates or any other clinical documents depend exclusively on the autonomous clinical decision of the Healthcare Professional;
c. The Healthcare Professional may refuse to prescribe or issue documents where this is not clinically indicated, without this constituting non-compliance, a failure of service or grounds for a refund.
Clause 6
(Emergency situations)
-
The Patient declares that they have been informed that remote clinical acts are not intended for medical emergencies.
-
In the presence of serious, sudden or potentially life-threatening symptoms, the Patient must immediately seek hospital emergency services or contact the national emergency number (112).
Clause 7
(Protection of personal data and health data)
-
The Patient is informed that their personal data and health data, as sensitive data, will be processed in strict compliance with the General Data Protection Regulation (GDPR) and applicable national legislation.
-
The data will be used exclusively for the following purposes:
a. Provision of healthcare;
b. Administrative management of the clinical act;
c. Communication relating to consultations, appointments, invoicing and clinical documentation;
d. Compliance with the legal and professional ethical obligations of the Healthcare Professional.
-
The Patient has the rights of access, rectification, restriction, objection and other rights provided for by law, which may be exercised in accordance with the applicable legal provisions.
Clause 8
(Confidentiality and recordings)
-
Graceful Existence - Unipessoal Lda. and all its professionals guarantee the confidentiality of clinical information, in accordance with the law and the relevant code of professional ethics.
-
Consultations are not recorded by the Healthcare Professional.
-
The Patient undertakes not to record the consultation, in whole or in part, without the prior, express and written consent of the Healthcare Professional. A breach of this duty may justify the interruption of the clinical act and possible notification to the competent authorities.
Clause 9
(Withdrawal of consent)
-
The Patient may withdraw this consent at any time. Withdrawal does not affect the lawfulness of clinical acts and data processing carried out up to that point.
-
The Patient acknowledges, however, that withdrawal of consent may prevent the provision of future remote clinical acts.
-
Withdrawal must be communicated in writing or through the channels made available on the platform
Clause 10
(Final declaration of consent)
-
By selecting the option “I have read, understood and accept the Informed Consent for the provision of remote clinical services”, the Patient freely, knowingly and unequivocally declares that:
a. They understand the nature, purpose, benefits, risks and limitations of remote clinical acts;
b. This Informed Consent must be read and interpreted in conjunction with the Terms and Conditions of Purchase of the clinical act;
c. They authorise the provision of healthcare via video call or telephone call;
d. They authorise the processing of their personal and health data for the purposes described;
e. They accept that clinical decisions are the sole responsibility of the Healthcare Professional;
f. The clinical act is provided by the Healthcare Professional identified at the time of booking, through the technological platform made available for that purpose;
g. They acknowledge that this consent is a necessary condition for the performance of the contracted clinical act.
